Smart Discovery Package

Pre-Litigation Decision Analysis

Published: 18 November 2025 | Reviewed: 26 September 2026

Before Litigation Begins

Before litigation begins, it can be difficult to see which available path will start further work, cost and procedural commitments.

The Smart Discovery Package gives you a fixed-scope first look before any litigation pathway is funded.

Clean Law is fully capable of courtroom advocacy but deliberately refrains from conducting contested hearings. This separation allows early advice to remain structurally independent from trial work.

What This Analysis Provides

A clear first assessment of:

  • the records and information you provide

  • the legal issues that may need attention

  • up to three high-level options

  • likely cost stages

  • timing risks

  • points where later decisions may narrow

The purpose is not to recommend litigation.
It is to clarify the consequences of each available path.

Diagram showing a litigation journey where changing circumstances may require reviewing available pathways. It illustrates that as a dispute develops, the system used to reassess options can matter as much as the original decision.

Process

For a fixed fee, Clean Law provides the preliminary analysis described above.

It does not commence litigation or prepare a courtroom brief. Any later settlement, escrow, tendering or courtroom work is separate and requires a further decision to proceed.

Why Structure Matters

Smart Discovery is separated from contested courtroom work and trial billing.

The Smart Discovery fee does not increase because litigation later begins, and Clean Law does not earn courtroom advocacy fees under this structure.

Suitable For

The Smart Discovery Package may help individuals or businesses who:

  • have a dispute of material financial or reputational significance

  • wish to understand cost exposure before funding litigation

  • want a client-side assessment before selecting a courtroom lawyer

It is not designed for routine transactional matters.

After Smart Discovery

After receiving the analysis, the client may decide whether to:

  • proceed with settlement, timing and escrow-oversight work

  • seek staged proposals through Independent Tendering

  • appoint another lawyer

  • seek further advice elsewhere

  • take no further step

No next step is required unless you choose it.
